Former Garfield County bookkeeper resentenced for embezzlement
A former bookkeeper in the Garfield County Clerk and Recorder’s Office has been resentenced to one less year in prison after a successful appeal of her original 10-year sentence.
The Glenwood Springs Post Independent reports that Robin McMillan, who pleaded guilty to embezzling public money last year, was resentenced Thursday to 9 years in prison.
Investigators estimate that she stole more than $440,000 of public funds from the clerk’s office.
The Colorado Court of Appeals vacated McMillan’s June 2015 sentence, finding it was illegal because McMillan had not been informed she had the right for a jury to determine whether her case has aggravating circumstances.
The judge sentenced her to the aggravated range in her original sentence, ignoring a prosecutor’s recommendation.
