Voters gave new terms to all of the 116 judges and justices who stood for retention this year across the state.

Most judges enjoyed significant support in favor of their retention, based on the early, unofficial results. Those included three members of the Supreme Court — Chief Justice Monica M. Márquez, Justice Brian D. Boatright and Justice Maria E. Berkenkotter — who all headed for new 10-year terms. Márquez and Boatright are the most senior members of the court, whereas Berkenkotter joined in 2021 and was standing for retention for the first time in her current position.

The citizen-led performance commissions that operate in each judicial district, plus the panel that reviews judges with statewide jurisdiction, found the judges up for retention this year generally met performance standards.

An exception was Garfield County Court Judge Angela M. Roff, whose performance commission believed she did not meet performance standards by a vote of 4-3, with three commissioners not participating.

As of 8:30 p.m., Garfield County voters were supporting Roff by a margin of just 45 votes out of more than 20,000 cast.

“This job is a privilege to hold, and I acknowledge the commission’s comments, favorable and unfavorable,” Roff wrote in response, to her performance evaluation this year. “I have supportive judicial mentors who assist with the steep learning curve of the job. I encourage everyone to observe my courtroom and see for themselves. I am dedicated to serving my community of 17 years with integrity, humility, and compassion.”

An appointee of Gov. Jared Polis, Roff took the bench in 2022.

In addition, Baca County Court Judge Milla Lishchuk received a 3-3 vote from her performance commission, with two absences and two vacancies. By default, a tie results in a recommendation of “meets performance standards.”

As of 8:30 p.m., voters in her county were on track to retain her by a 51%-49% margin.

In general, the performance commissions’ analysis does not provide a complete picture of judicial performance statewide. Judges may choose to retire preemptively rather than let an unfavorable performance evaluation be submitted to voters.

County court judges who were retained will now serve an additional term of four years. District court judges will receive a six-year term and Court of Appeals judges will have eight years until their next retention.
