Polis signs 34 more bills into law | CROSSING THE FINISH LINE

With 16 days left in Colorado’s 2023 legislative session, Gov. Jared Polis has signed 128 bills into law. 

After being signed, bills take effect in August, 90 days after the general assembly adjourns, unless otherwise specified in the bill. A full list of legislation signed this year can be found online by clicking here

Here are all of the bills signed into law this week. 

House Bill 1191: Prohibit corporal punishment of children

Prohibits the use of corporal punishment on children by employees or volunteers in state licensed preschools or in K-12 public schools. Signed on Thursday. Read more about the bill here.

Senate Bill 221: Healthy school meals for all program fund

Implements several measures related to revenue and expenditures for the Healthy School Meals for All Program, approved by voters in November 2022. Signed on Thursday.

Senate Bill 222: Medicaid pharmacy and outpatient services copayment

Removes the requirement that Medicaid recipients pay a copayment for pharmacy and outpatient services. Signed on Thursday.

Senate Bill 226: Extending transitional jobs program

Extends the Transitional Jobs Program in the Department of Human Services for five years until July 1, 2030. Signed on Thursday.

Senate Bill 219: Supports to students and facility schools

Makes changes to state law related to the regulation and funding of facility schools. Signed on Thursday.

House Bill 1151: Clarifications to 48-hour bond hearing requirement

Clarifies the state’s 48-hour bond hearing requirement for individual’s in custody. Signed on Thursday.

Senate Bill 216: Colorado universal preschool program funding

Removes a transfer to the Preschool Programs Cash Fund and instead requires that the amount be appropriated to the Colorado Department of Early Childhood. Signed on Thursday.

Senate Bill 217: Separating fees in records and reports cash fund

Eliminates the requirement that fees from background checks for child abuse and neglect be used to cover the costs of the appeals process in the Department of Human Services. Signed on Thursday.

Senate Bill 235: DOL funds for unanticipated state legal needs

Authorizes the Department of Law to use appropriations for litigation management to address unanticipated state legal needs. Signed on Thursday.

Senate Bill 243: General fund transfers to capital construction fund

Makes various transfers to fund capital construction and information technology projects. Signed on Thursday.

Senate Bill 244: Technology accessibility cleanup

Updates and clarifies accessibility standards for state information technology systems. Signed on Thursday.

Senate Bill 245: Transfer to revenue loss restoration cash fund

Transfers money to the Revenue Loss Restoration Cash Fund in the current FY 2022-23. Signed on Thursday.

Senate Bill 246: State emergency reserve

Transfers money from the General Fund and the Revenue Loss Restoration Cash Fund to the State Emergency Reserve Cash Fund on June 30, 2023. Signed on Thursday.

Senate Bill 228: Office of Administrative Services for Independent Agencies

Creates an independent administrative support office to support independent agencies within the Judicial Department. Signed on Thursday.

Senate Bill 237: Transfer to water plan implementation cash fund

Transfers $12.6 million from the Severance Tax Operational Fund to the Water Plan Implementation Fund. Signed on Thursday.

House Bill 1179: Agricultural products inspection cash fund reserve

Excludes the Agricultural Products Inspection Cash Fund from the limitations of uncommitted reserves and allows for an uncommitted balance of up to 50% of the amount spent during the fiscal year. Signed on Thursday. 

House Bill 1185: Requirements for recall elections and vacancies

Makes several changes to the requirements for recall elections and filling municipal government vacancies. Signed on Monday. Read more about the bill here

Senate Bill 146: Colorado apprenticeship directory information

Modifies the information included in the Colorado State Apprenticeship Directory. Signed on Monday. 

Senate Bill 197: Fiscal year 2023-24 legislative appropriation bill

Makes appropriations for matters related to the legislative department for the 2023-24 state fiscal year. Signed on Monday. 

Senate Bill 215: State employee reserve fund general fund transfer

Makes a one-time $4,913,753 transfer from the State Employee Reserve Fund to the General Fund. Signed on Monday. 

Senate Bill 218: Repeal school transformation grant program administration cap

Removes the cap on administrative expenses for the School Transformation Grant Program in the Colorado Department of Education, and makes an appropriation. Signed on Monday. 

Senate Bill 223: Medicaid provider rate review process

Alters the timeline for the Medicaid Provider Rate Review Advisory Committee report. Signed on Monday. 

Senate Bill 224: CO communication policies postgraduate student exchange program

Modifies state law regarding higher education professional student exchange programs. Signed on Monday. 

Senate Bill 225: Specialty education CSU Medical School partnership

Expands the acceptable use of funding for specialty education programs. Signed on Monday. 

Senate Bill 227: State agency attorney hourly rate

Increases the hourly rate for contract attorneys at the Alternate Defense Counsel, the Office of the Child’s Representative, and Office of Respondent Parents’ Counsel to $100 per hour in FY 2023-24, with additional increases in future years. Signed on Monday. 

Senate Bill 230: County assistance for 23rd Judicial District

Appropriates money to reimburse counties for eligible expenses for establishing the new district attorney’s office in the new 23rd Judicial District. Signed on Monday. 

Senate Bill 231: Amend fund to allow payment overdue wage claims

Allows the Department of Labor and Employment to use the Wage Theft Enforcement Fund to pay employees for unpaid liabilities resulting from wage law violations, and makes the fund continuously appropriated for this purpose. Signed on Monday. 

Senate Bill 233: Employment services funded by Wagner-Peyser Act

Requires counties with employees funded through the Wagner-Peyser Act to develop merit systems that comply with federal standards. Signed on Monday. 

Senate Bill 236: Electric vehicle service equipment fund

Creates the Electric Vehicle Service Equipment Fund in the Department of Military and Veterans Affairs. Signed on Monday. 

Senate Bill 239: Hazardous site response fund transfer

Transfers money to the Hazardous Substance Response Fund in the current FY 2022-23. Signed on Monday. 

Senate Bill 242: Community corrections financial audit

Requires the Division of Criminal Justice in the Department of Public Safety to contract with an independent third party to audit community corrections programs by January 1, 2024, and every five years thereafter. Signed on Monday. 

House Bill 1062: Metropolitan district tax for parks and recreation

Allows a metropolitan district to levy a sales tax to provide parks or recreational facilities or programs, along with other allowable uses. Signed on Monday. 

House Bill 1137: Solar garden net metering credits stabilization

Modifies how fixed bill credits are calculated for community solar gardens. It minimally increases state expenditures in FY 2023-24 only. Signed on Monday. 

House Bill 1157: Uniform unregulated child custody transfer act

Prohibits certain transfers of child custody without a legal proceeding, prohibits soliciting a prohibited child custody transfer, and requires child placement agencies to provide prospective parents with certain information about the adoptee. Signed on Monday.
