An independent, third-party external review of the Elijah McClain case is expected to be released to the public Monday, the City of Aurora announced on Friday.

City officials expect to receive the report Monday morning and will immediately make it public, they said in a news release. 

The investigation team will then present their findings to Aurora’s City Council at a special study session on Monday at 5 p.m. before its regular council meeting. 

In July, the council unanimously approved a resolution that opened an external investigation into the McClain case.

The 23-year-old Black man encountered Aurora police officers in August 2019 while he was walking home after a report of a person behaving strangely. Officers demanded McClain stop, but he refused, which prompted the officers to physically take him down and put him in a chokehold.

When Aurora Fire and Rescue personnel arrived to the scene, paramedics diagnosed McClain with excited delirium and administered a 500 mg dose of ketamine, a sedative.

McClain suffered cardiac arrest and never regained consciousness. He was pronounced brain dead on Aug. 27 and taken off life-support three days later. 

Last month, Attorney General Phil Weiser announced he was opening a grand jury investigation into the 23-year-old’s death.

“Our investigation will be thorough, guided by the facts and law, and worthy of the public’s trust,” Weiser said in a news release. “In order to maintain the impartiality and integrity of the process, we have no further comment at this time.”
