Former Vice President Mike Pence announced Monday that an amicus brief had been filed by his group, Advancing American Freedom, to the U.S. Supreme Court in firm opposition to the Occupational Safety and Health Administration’s vaccine mandate, according to an AAF press release shared with the Washington Examiner.

The brief labels the mandate “unconstitutional” and backs demands for a stay.

The mandate, which OSHA published as Emergency Temporary Standard, seeks to “shortcut normal rule making requirements” as set by Congress, the release noted.

It must be stayed “to prevent the irreparable harm to Americans, to jobs, to constitutional governance, and to our cherished freedoms,” the AAF argued.

“America is about freedom and the ability to make the best decision for your family or business, and Joe Biden’s vaccine mandate must be stopped in its tracks in order to preserve freedom, protect American livelihoods and businesses, and to safeguard our constitution,” Pence, the founder of AAF, said.

“Joe Biden’s vaccine mandate is not the American way, and Advancing American Freedom will always stand up to unconstitutional overreach from the Executive Branch that infringes on the freedoms we so greatly cherish.”

OSHA’s ETS fails to recognize the limitations imposed on the Executive Branch by the Constitution, according to the release.

Unless authorized by Congress, the president cannot unilaterally impose bodily mandates or establish barriers to working against the citizens of the U.S., according to the AAF.

Nine previous OSHA ETSs are used to bolster the argument of the AAF.

“All of the nine previous ETSs sought to regulate an asserted occupational danger or toxin that arose in the workplace [e.g., asbestos, pesticides, carcinogens, or chemicals] and no previous ETS attempted to require or coerce employees ‘to undertake a medical procedure [a vaccination] that cannot be undone at the end of the workday,” the release read.

The brief also posits that OSHA seeks to use emergency authorities to accomplish a goal that Congress does not support, according to the release.

That goal is the mandated vaccination of the public of the U.S.
