Attorney for alleged victim pushing for disclosure of all sex harassment complaints against Colorado lawmakers

An attorney for one of the alleged victims of sexual misconduct by a Colorado legislator said hiring an outside “gatekeeper” who would handle all workplace and sexual harassment complaints in the state Capitol is not enough.

“I’m pleased that the legislature is stepping up to hire HR professionals to improve their internal policy and training, however I am concerned that victims are being left out of the process,”Alan Kennedy-Shaffer said after the vote by legislative leaders to hire outside help.

Meeting with reporters after adjournment, Kennedy-Shaffer said legislators need to address a lack of transparency at the Capitol when it comes to reporting of sex assaults and harassment.

“We would like to know the number of complaints that have been filed, who they’ve been filed against, what was the ultimate disposition of those complaints, the date when they were filed and the date of when there was an outcome,” he said. “Under the current policy … there’s no way for the victims, the public or the media to know how many complaints have been filed against individual legislators. That’s part of the problem. We know that multiple complaints against multiple legislators have piled up without the legislature taking action.”

He said he’s contemplating legal action to compel disclosure of all complaints that have been filed against legislators.

Kennedy-Shaffer tried to speak at Friday’s Executive Committee of the Legislative Council hearing at the Capitol, but was immediately silenced by Senate President Kevin Grantham, who reminded him no public testimony was allowed and asked him to “respect the process.”

When House Speaker Crisanta Duran was asked whether there will be public hearings so that victims and their attorneys could speak out, she didn’t give a direct answer.

The outside professional, once hired “will be taking feedback from the public, victims, legislators, lobbyists – all interested parties – to make recommendations to us to ensure that we have the best policy possible,” Duran said.

 

Kennedy-Shaffer  also said he was not impressed with the committee’s vote to increase the frequency of workplace harassment training sessions that legislators and staff receive.

“We know that each member of the legislature received sexual harassment in January, and yet that did not seem to prevent further sexual harassment,” he said.

Kennedy-Shaffer said Joint Rule 38 – the legislature’s current policy to protect victims of workplace harassment – does not specifically prevent disclosure of the number of complaints filed against legislators.

“However, the attorneys for the legislative leaders have interpreted Joint Rule 38 to prevent disclosure,” he said.

The names of the legislator and alleged victim represented by Kennedy-Shaffer have been withheld from this story due to lack of corroboration in the incident.
