Broomfield Enterprise editorial: Construction defect reform is welcomed

.After years of failed efforts to address builders’ concerns about the state’s construction defects law, it appears a compromise solution is on the way.

On Thursday, the Colorado Senate approved House Bill 1279, a bill that will make changes to the requirements facing owners of condominium units who want to sue builders because of perceived construction defects.

The measure now goes to Gov. John Hickenlooper’s desk, where it is assumed he will sign it.

Because of the threat of legal challenges, condominium builders have been reluctant in the past few years to build multi-family, owner occupied housing. According to statistics provided to lawmakers, the sector once accounted for one-fifth of residential construction in the state but has decreased to just 3 percent in the most-recent year for which statistics are available.
