Gov. Jared Polis signs bill barring HOAs from prohibiting home-based businesses
Gov. Jared Polis has signed a measure into law that prohibits homeowners associations from barring the operation of home-based businesses, saying it is one of his “favorite” bills this session.
Under Senate Bill 134, a home-based business must still comply with an HOA’s rules and regulations around things like architectural control, parking, landscaping, and noise levels. The operation of a home-based business must also be compliant with local noise and nuisance ordinances.
Polis noted he and a friend started their first business out of his friend’s mother’s garage in their early 20s.
“There are all kinds of businesses that you can run from your home,” he said. “It saves overhead and encourages entrepreneurship. This bipartisan bill prohibits HOAs from infringing on people’s rights to run their businesses from their home.”
“Starting a new business can be hard, and sometimes you have to do it by starting inside your own home before you can grow and expand into a storefront or office space,” said bill sponsor Sen. Tony Exum, D-Colorado Springs. “Some HOAs discourage their own members from running any business within their own home. And we think that’s not right. Creativity should be encouraged, not suppressed.”
The bill is also sponsored by Sen. Jim Smallwood, R-Sedalia, and Reps. Jenny Willford, D-Westminster, and Ron Weinberg, R-Loveland.
